Marketing communications. You may receive marketing communications from FourthWall, including if you sign up for marketing or other communications. You may opt out of receiving marketing emails by following the unsubscribe link in each email.lease note that you may continue to receive non-marketing emails from us after you opt out. Please note that we do not control communications from others. If you have received marketing communications from third parties, you should contact those third parties directly to understand communication choices they may provide you. Third parties include those who may be interacting with us on your behalf in connection with group activities.

Cookies. You have choices regarding certain cookies. Most web browsers automatically accept cookies, but you may modify your browser’s setting to notify you of cookie placement or decline cookies. Our Website and Services are not intended to be provided to minors. Any access to or use of the Website or Services by anyone under the age of 13 is unauthorized. This Additional Notice applies to residents of California whose personal information FourthWall processes subject to California law. California requires covered businesses to make certain disclosures and offer data rights. FourthWall collects and processes personal data to allow our customers and their representatives (“Customers”) to understand and analyze television, cable, satellite, broadcast, and device viewership data and to extract meaningful insights from such data. We provide our Customers with demographic data about specific TV programming and advertisements viewed by households and related reporting and tracking to understand the effectiveness of these programs and advertisements.

This Additional Notice applies to our collection and reporting services that we provide to our Customers (“Services”) and to our website (“Website”). This notice is addressed to our Customers, visitors to our Website (“Visitors”), and to the consumers whose data is collected and processed as a part of our Services to our Customers (“Consumers”). All capitalized terms not otherwise defined in this Additional Notice will have the meaning assigned to them in the Privacy Notice.

These disclosures and rights may not apply to data not processed by FourthWall or for which FourthWall does not determine the purposes and means of processing. If you are a Consumer and you have questions regarding how your personal data is processed by our Customers, please contact the relevant Customer directly.

COLLECTION OF PERSONAL INFORMATION

We collect personal information as necessary to operate our business, to comply with our legal and regulatory obligations, and to provide our services to you. Within the last 12 months, we have collected the following types of personal information:

Identifiers unique household identifier, household IP address, or other similar identifiers;
Usage data such as information on a consumer’s TV viewing, times and duration of viewing.
Protected classifications such as your household demographic information including age, gender, and other similar classifications. Additionally, we collect information about your household television and video viewing..

COLLECTION OF SENSITIVE PERSONAL INFORMATION

FourthWall does not knowingly collect or process any Sensitive Personal Information—including citizenship or immigration status—and therefore does not use such data for any purpose. Should FourthWall ever seek to collect SPI, we will provide a separate ‘Limit the Use of My Sensitive Personal Information’ mechanism and updated notice prior to collection.”

HOW PERSONAL INFORMATION IS COLLECTED AND USED

To provide our Services to our Customers. We may provide our Customers with the ability to receive, combine, analyze and report on the collected data. This provides insights regarding their advertising, campaigns and other promotions including the viewership of their ads and helps identify target audiences for additional advertising.
To maintain, analyze, customize, measure, and improve our Services, which includes generating internal reports about the use of our Services.
To send transactional communications, including requests for information, responses to requests for information, and other Service updates.
To provide customer support.
To communicate with our customers, including about products updates and offerings that we think they may be interested in.

In the last 12 months we have disclosed Visitor and Consumer personal information to third parties in connection with operating and providing our Services, including network identifiers and inferences about your preferences to third party analytics providers. Such disclosure for analytics and marketing / advertising purposes constitutes a “sale” of your personal information under California law. You may opt out of the sale of your personal information by filling out the form Do Not Sell or Share. We do not sell the personal information of individuals who we know to be under 16 years of age. DATA STORAGE AND RETENTION

FourthWall retains each category of personal information only for the minimum period necessary to fulfil the purpose(s) disclosed below, after which the data is securely deleted or de-identified.

FourthWall will not retain personal information longer than is reasonably necessary for each stated purpose.

YOUR CALIFORNIA RIGHTS

If you are a California resident, you have the following rights regarding your personal information:

Right to Access. You have the right to access the personal information we have collected about you. You may exercise this right twice within any 12-month period free of charge.
Right to Know. You have the right to request that we disclose the following about your personal information in the preceding 12 months:

c. The business or commercial purposes for collecting, selling, or sharing your personal information;

“Cross-context behavioral advertising means the targeting of advertising to you based on the personal information obtained from the activity across businesses, distinctly branded internet websites, applications, or services, other than the business, distinctly branded internet website, application, or service with which you intentionally interact.
Right to Limit Use of Sensitive Personal Information. FourthWall does not collect information that is considered “sensitive” personal data.

We may not discriminate against you for exercising any of these rights. This means that we may not deny you services or charge you different prices or rates for services or provide you with a different level or quality of services (or suggest that we will do so), in response to a request. However, we may charge different prices or rates, or provide a different level or quality of services, where that difference is reasonably related to the value provided to us by your personal information.

You may designate an authorized agent to make a request to know, request to correct, or request to delete on your behalf. An agent may be an individual or a business entity. To designate an authorized agent, you must provide the agent with written permission to submit the request. We may still require you to verify your identity directly (subject to certain exceptions). We may refuse a request if the agent does not provide adequate proof of their authorization.

COLLECTION OF SENSITIVE PERSONAL INFORMATION

Under Colorado law, “sensitive data” is defined as personal data revealing racial or ethnic origin, religious beliefs, a mental or physical health condition or diagnosis, sex life or sexual orientation, or citizenship or citizenship status, genetic or biometric data that may be processed for the purpose of uniquely identifying an individual, or personal data from a known child, or biological data (including neural data) —i.e., information generated from the measurement of an individual’s biological, biochemical, physiological, or neural activity.

FourthWall does not knowingly collect or process any Sensitive Data, including biological or neural data. Should we later seek to collect such data, we will first obtain your affirmative opt-in consent and will update this Additional Notice accordingly.

UNIVERSAL OPT-OUT SIGNALS

We honor browser- or device-based Universal Opt-Out Mechanisms (UOOMs) recognized by the Colorado Attorney General. At present, the only approved UOOM is Global Privacy Control (GPC). When your browser transmits a valid GPC signal, we automatically treat it as a request to opt out of (i) targeted advertising and (ii) the sale of your personal data, without any further action required from you.

YOUR RIGHTS AND CHOICES

As a Colorado resident, you have specific rights regarding your personal information. This section describes those rights and explains how to exercise those rights.

1) Right of Access. You have the right to confirm whether we process your personal information and to access your personal information.

2) Right to Portability. When exercising the above right to access personal information, you have the right to obtain data in a portable and, to the extent technically feasible, readily usable format that allows you to transmit the data to another entity without hindrance. 7) Right to Opt-Out of Profiling. We do not process personal data for the purposes of profiling under Colorado law

You may also exercise your rights to opt out of targeted advertising and data sales yourself through a user-selected universal opt-out mechanism. We may, as permitted by law, deny your request if we cannot, through reasonable effort, verify your identity or your agent’s authority.
